People With Severe Accident Injuries and Costs Can Seek Litigation Funding

October 13, 2011

Pedestrian and bus accidents are not all that common. A bus usually wins and this accident shows how it severely impaired the survivor for life.

Alfreda was minding her own business one day in 2009. In fact, she was waiting for the pedestrian walk signal, before she started to cross a busy New York street. The signal changed, indicating it was safe for her to proceed across. At roughly the halfway mark, she was run over by a bus being driven by a Metropolitan Transport Authority driver.

When the emergency medical crew arrived to take her to the hospital, they were not sure she was going to make it. She did, but came out of surgery missing an arm and a leg, and blinded in one eye. At the age of 59 years old, this is a life altering, catastrophic accident that left a woman unable to perform many of the daily living tasks we all take for granted.
Alfreda hired a personal injury lawyer to get her the kind of compensation she would need to be able to pay for her care. The case was successful at trial, and she was awarded $20 million. Trial documents clearly showed that she had waited for the pedestrian walk signal before crossing the road and that the driver ignored the signal.

The transit authority was not happy with the decision and plans to appeal. The authority contends that the bus was already in the crosswalk before the victim, so the driver had the right-of-way. This was a catastrophic accident for Alfreda and she faces a completely different life than she enjoyed before.

Just after her accident, the victim spoke to a personal injury lawyer to start the long process of trying to recover compensation for her serious injuries. She did not have money to pay the enormous medical bills she had incurred, and was trying to wrap her head around how she would get the care she needed without money. Litigation typically takes months or years to resolve. The perfect answer would have been for her to apply for litigation funding from a “lawsuit loan” company.

Pre-settlement funding is an emergency lawsuit cash advance that is designed to allow plaintiffs to get back on their feet financially, and carry them through until the case is resolved by a verdict or equitable settlement. Legal finance is easy to apply for and, if approved, reduces the financial stress associated with a serious injury accident.

Although this “lawsuit loan” may be used as one pleases, plaintiffs should utilize lawsuit finance for important bills and expenses. With financial issues out of the way, plaintiffs have the time and money to let justice take its course and they can decline inadequate offers and wait for a fair, proposed settlement.

If you have been injured in an accident as the result of someone else’s negligence, and you are pursuing a lawsuit with the assistance of a seasoned personal injury attorney, litigation funding is worth checking out if you need cash to pay your bills while the lawsuit is pending.

Drinking and Driving Hardly Ever has a Happy Ending

September 30, 2011

You would think people would learn that if you drink and drive, you take your life and the lives of others into your very dangerous hands.

Day after day, week after week, year after year, people get killed by drunk drivers. Yet people continue to drink and drive. People continue to get seriously hurt or killed because someone made the stupid decision to get behind the wheel despite being inebriated. This is a case where two teens who should not have been drinking in the first place, decided to drink and drive. As a result, two people are dead and one is seriously injured after a single-vehicle rollover.

The police reports show that speed and booze were significant factors. Three teens, two 16-year-olds and a 15-year-old, were speeding along a roadway just before midnight, enjoy an evening of boozing and schmoozing. The car veered off the road, flipped, and landed on its hood. The 16-year-old driver was pronounced dead at the scene, as was one of his passengers. The lone survivor of the wreck was evacuated by medevac to the nearest medical center in serious but stable condition.

Evidently, the teens had been camping with a group of other students in the canyon where they began drinking to pass the time. All victims were last seen at the campsite about 8:30 p.m. When the three did not return, others went looking for them, found the crash scene, and called 911.

This is a tough case. The kids willingly got into a car with a drunk driver and were drunk themselves. The dead passenger’s family should be able to file a wrongful death lawsuit. The injured girl’s family should be able to file a personal injury lawsuit to recover compensation for her injuries. Whatever the families do choose to do, death and injury often cause a host of financial problems for victims and their families.

After retaining attorneys and filing lawsuits, both families may wish to consider applying for litigation funding, also referred to as pre-settlement funding. This is money paid in advance of a court verdict or settlement. The plaintiffs apply, provide case details, have their case assessed and approved. After the 24 to 48 hour approval process, a lawsuit cash advance is wired into their bank accounts. It is a very simple process and the money can be used for any important reason.

Lawsuit funding puts plaintiffs back on their feet when they need financial help the most. In addition, a lawsuit cash advance provides important leverage to turn down inadequate offers from a greedy insurance company, which will often use plaintiffs’ financial desperation to obtain lower-than-full-value settlements.

Child Shot While Playing on Neighbor’s Front Lawn

September 27, 2011

This case is as tragic as it is unbelievable. Cleveland, Ohio police arrested a man after he shot an 11-year-old girl who was playing on his front lawn. Evidently he was angry because a group of kids were playing in his yard and bumped into his car.

A 10-year-old witness said the victim, Ivhan’e Merritt, was one of the kids on the lawn when Charles DuBose opened fire. At the sound of gunfire, the kids ran; Ivhan’e was yelling that she had been shot. Her friends thought she was making it up until she fell to the ground. The little girl was rushed to hospital where it was discovered the bullet had grazed her liver; currently her recovery status is unknown.

It is likely that the girl’s mom will speak to a personal injury lawyer about this case. Assuming the neighbor was trying to scare the children and not trying to hurt anyone, his conduct was at least negligent. If his conduct is determined to be negligent, not intentional, his homeowners insurance would apply to help the child’s family deal with the enormous medical bills for their wounded daughter. But litigation can take months, even years, to resolve.

How will they get by with these additional expenses hanging over them? If a lawyer takes her case and pursues a negligence claim, the mother can apply for litigation funding from a lawsuit funding company. Legal finance is easy to apply for and will help tide her over until her verdict comes in or she reaches an equitable settlement.

Pre-settlement funding is a lawsuit cash advance that lets the plaintiff pay off important bills and expenses. Even though this “lawsuit loan” can be used as one pleases, plaintiffs should utilize this lawsuit financing for important bills and expenses. With financial issues out of the way, plaintiffs now have the time and money to let justice take its course. They can decline inadequate offers and wait until a proposed settlement is fair.

If you have been injured in an accident as the result of someone else’s negligence and you are pursuing a lawsuit with the assistance of an experienced personal injury attorney, litigation funding is worth checking out if you need cash to pay your bills while the lawsuit is pending.

Fire Captain Loses Life Due To Grandfather Clause

August 4, 2011

The Bureau of Alcohol, Tobacco, and Firearms and Explosives (ATF) and the Asheville Fire and Police Departments have determined that the tragic fire on July 28th, at a Medical Office Complex in Asheville, NC. was deliberately set. A Fire Department Captain was suffered cardiac arrest and died battling the flames. Ten other firefighters were treated for minor to serious injuries. Over $20 million in damage occurred as a result of the fire. What remains unknown is who started the blaze and why.

The building safety director for the city said the death most likely could have been prevented if the building been equipped with sprinklers. The facility was built prior to North Carolina changing its fire code requiring multi-family and high-occupancy buildings to have sprinkler systems and the owners were not required to retrofit.

Sometimes a new city ordinance or building code change will immediately cause hundreds of older buildings to be in violation. But, rather than bringing buildings up to code, the government will insert a grandfather clause – an exemption allowing current businesses or property owners to continue operating under previous laws – into the language of the new regulation. In this case, the medical facility may have been exempt from modern sprinkler laws because the retrofitting would be too costly. Although a grandfather clause is often used to benefit owners who may otherwise face financial or personal hardship under new regulations, it is also allowing unsafe conditions. Is this another case of lawmakers putting the interests of the business community over citizens? Do tragedies like this one reveal the underlying weakness in the system?

We urge business owners to be proactive and go beyond minimum code requirements in making their buildings as safe as possible.

The families of those injured and killed in the fire may decide to talk to a personal injury attorney about their rights. If there was negligence on the part of the building owner, a personal injury lawsuit is likely.
Cases like this tend to take a long time from lawsuit commencement to lawsuit resolution; litigants/family members, struggling to make ends meet dealing with with funeral and burial or medical assistance expenses rendered at the time of the fire, may wish to consider applying for lawsuit funding. This is a service that provides a lawsuit cash advance to people involved in pending lawsuits. The main purpose of this legal finance service is to prevent cash strapped litigants from having to settle their valuable cases too soon, for too little, because the need lawsuit cash now. Legal funding may make a substantial difference in the bottom line of your case.

Woman Says Wrongful Death Lawsuit Is About Pushing For Stricter Regulations

July 11, 2011

A horrifying chain of events occurred last October. An 18-wheeler slammed into a line of vehicles stopped on a busy interstate. Five people were killed. Investigators said seven vehicles were stopped on the interstate after an accident involving a dump truck. The driver of the tractor-trailer came up behind the stopped vehicles and, without slowing down, hit three of them causing an accordion-type effect. The force slammed six vehicles into the back of each other. Witnesses said the trucker was speeding and driving erratically.

Driver inattention, driver fatigue, and distracted driving are three of the most common causes of truck accidents. We know that even one death is unacceptable, but the important question is how do we improve these statistics and make our roadways safer? A mother who lost her son in this tragic accident filed a wrongful death lawsuit, but she is also pushing for stricter safety policies and better regulations of the trucking industry.

How can trucking companies stress the importance of driver safety when so many drivers are expected to operate under tight schedules without considering possible variables such as auto accidents and construction delays? How safe is the truck driver 14 hours of service rule? Is greed pushing these truckers to their limits?

This trucking accident may take several months, or years, to resolve. The plaintiff might be interesting in learning about lawsuit funding, a financial service that will provide financial assistance in advance of an expected settlement or verdict. The lawsuit cash advance would give the plaintiff cash now to remove the financial pressure to settle too early for too little compensation.

Wrongful Death Lawsuit D.C. Train Accident Still Unresolved

June 28, 2011

June 22 marked the two year anniversary of the most fatal public rail system accident in 33 years. The accident occurred in Washington near the Fort Totten station when one commuter train rear-ended another during rush hour. Investigators determined that the cause of the crash was a malfunctioning electronic circuit. The train operator and eight passengers died. In addition, over 70 people went to local hospitals to be treated for injuries that ranged from minor sprains, cuts and bruises to life-threatening injuries.

The National Transportation Safety Board (NTSB) had previously recommended that the Washington Metropolitan Area Transit Administration (WMATA) change these cars because the ability to make it through a train accident was not certain, but cost concerns prevented the WMATA from doing so. Could this devastating train accident have been avoided if the WMATA did not ignore the NTSB’s warnings? Were other warning signs ignored as well?

Lawsuits filed by victims and their families have been consolidated into one case. Although some progress has been made, the pending lawsuits may not be resolved until 2012. In addition to providing compensation to the victims, a wrongful death lawsuit can express the importance of following up on safety warnings before tragedies occur.

It has already been a long road in seeking justice for the victims and their families. As the litigation process continues, many victims may be experiencing difficulty paying the mortgage, rent, car payment, medical expenses, funeral expenses, and other important bills. What can they do until a settlement is reached?
One possible solution is lawsuit funding. A lawsuit cash advance will help pay the bills, relieve financial obligations, and provide the ability to wait for a fair and equitable settlement. Applying for pre-settlement funding is quick and easy; the process can be completed within 24- 48 hours. A lawsuit cash advance may be the strategic move to retain financial security while waiting for case resolution.

Man Falls Down Elevator Shaft When Doors Open Between Floors

March 7, 2011

In this case, a man filed a lawsuit against a building owner for negligence in properly maintaining an elevator. The man alleged that when he leaned against the elevator doors, they sprung open causing him to plummet fifteen feet down the elevator shaft. The plaintiff contended that the elevator was negligently maintained by the defendant and that the defendant’s failure to properly maintain the elevator was the direct proximate cause of his accident. Specifically, the plaintiff contended that the safety device which normally prevents an elevator from opening when the car is not level with the landing malfunctioned. The defendant claimed that the elevator is on a regularly scheduled maintenance check, and he was unaware of any defects. Upon a detailed investigation, it was determined that the elevator had several deficiencies. The plaintiff was awarded compensation for damages and loss wages.

Elevator injuries are similar to premises liability lawsuits. The owner of a building is responsible for properly maintaining an elevator and if someone is injured as a result of negligent maintenance, the owner can be legally responsible for injuries. When a person is the victim of an accident directly related to the failure or malfunction of an elevator, they have the legal right to seek compensation for damages. In this case, it is easily apparent that someone was at fault; elevators won’t malfunction at will. For individuals who have experienced similar accidents, being able to financially wait out the time it takes for your attorney to seek justice is paramount.

Due to the complexity of elevator lawsuits, the litigation process in these types of accidents may be far off. For some people pre-settlement funding is a way to make it through the long and tedious process of waiting for a settlement. A lawsuit cash advance for some people can provide the financial security of paying bills while waiting for a fair and full settlement from their claim. If you are in need of a lawsuit cash advance, begin by applying online. Don’t worry about a bad credit history or unemployment. With us, those don’t matter. There are no monthly payments, either. Best of all, with our company you only repay the cash advance if you win your case. With lawsuit funding, you can get back financial control of your life.

School Children Hit By Auto As They Stand Outside of School

February 21, 2011

Four boys standing were standing on a street corner near school when a Toyota Prius that jumped the curb, hit the boys, and pinned one of them underneath the vehicle. According to one of the boys, the Prius was making a turn when a speeding Sienna van slammed into it. After the two vehicles collided, the Prius went up on the curb and struck the boys before slamming into a wall. Firefighters used air bags to lift the Prius off the 12-year-old trapped underneath. He and another 12-year-old suffered traumatic injuries; a 7 and 11 year old were treated at the hospital and released. The driver of the Prius was hospitalized, but the extent of her injuries was not immediately clear. The driver of the Sienna was not injured.

A preliminary investigation indicated the driver of the Sienna turned in front of the Prius. Why the driver was speeding is unknown. Authorities investigating this serious auto accident do not believe that alcohol or drugs played a factor. What is known is that the families of these young boys, as well as the driver of the Prius, may consider filing a personal injury lawsuit.
