Two Families Filed Lawsuit in Palm Springs Tour Bus Fatal Crash

The families of two victims in last week’s deadly bus crash near Palm Springs have a filed lawsuit against the bus company and the estate of the bus driver. The suit claims the bus driver failed to travel at a safe speed and failed to brake to avoid the crash. It also claims that the bus was not properly maintained

Thirteen people were killed and 31 others injured after the bus slammed into the back of a big rig. The bus was carrying 44 passengers who were returning from a trip to the casino. The driver was one of the owners of the bus company, which typically ferries people from LA to nearby casinos. The impact pushed the trailer about 15 feet into the bus. It took nearly two hours to separate the vehicles.

The National Transportation Safety Board this week said the bus did not comply with vehicle safety standards because two of its eight tires lacked sufficient tread. As a federal probe into the crash continues, an attorney for the plaintiffs said that there is also reason to believe that the tractor trailer driver may be at fault. According to a witness, I-10 was shut down in both directions and the truck was parked in an active lane with the headlights off when the crash occurred. There were no flashing lights; all that was illuminating was the parking brakes. The investigation is ongoing; the families’ attorneys are simultaneously conducting an independent investigation.

Wrongful death cases are never easy for the families of the deceased, but filing them may serve to provide necessary financial resources for support in the absence of a family breadwinner. Although a lawsuit will not bring a loved one back, it may provide the added benefit of reducing the chances that a similar occurrence will happen to someone else. While awaiting the resolution of a wrongful death lawsuit, the deceased’s family may have difficulties making ends meet. In a lawsuit setting, this type of financial distress is often alleviated when a family seeks litigation funding.

Litigation funding can help provide the means for a victim’s loved ones to get through the long haul of a wrongful death lawsuit without feeling pressured to settle due to financial burdens. Instead, they can allow their attorney to reach a fair settlement, more representative of the true extent of damages.

After receiving a funding application and applicable case documentation, Litigation Funding Corporation can typically make a funding decision in less than 24 hours because we do not require a credit check or employment verification. Funding is based solely on the strength of the case being offered as collateral. Funding also comes with zero risk for the plaintiff. Repayment of the cash advance is only made when the case successfully settles. If the plaintiff loses, the cash advance is waived in its entirety. There are also no specific restrictions on how the money is used.

If a loved one was fatally injured by the negligence or wrongdoing of another and you have filed a lawsuit but struggling financially to see your case through to the end, you may qualify for litigation funding against the future proceeds of your claim.
