Fiery Tanker Crash Kills South Carolina Family of Four

June 5, 2017

When fault on the part of a truck driver or a trucking company results in injury or death, victims may be eligible to recover compensation with the help of a trucking accident attorney.

A family of four died on May 16, 2017 after their vehicle was struck by a tractor trailer that apparently failed to slow in a construction zone.

The driver of a Volvo tanker was traveling south toward a construction zone where crews were painting Interstate 95 near the South Carolina state line. According to state police, the driver did not reduce speed and slammed into a pickup truck, pushing the pick-up forward, causing a chain-reaction crash with two SUVs. The tanker then struck another tractor-trailer, which was pushed into a third semi. Gasoline in the tanker ignited; the Volvo ran onto the shoulder and caught fire.

State Police identified the deceased family as a 32-year-old female, a 25-year-old male, and two daughters, one and four years old. The tanker driver also died. Three people in one of the SUVs and the driver of another were flown to hospitals with serious injuries. They have been reported in stable condition. The drivers of two of the other tractor-trailers were treated and released at the scene.

The fatal crash remains under investigation.

The last thing the injured victims or the family of the deceased need is to face legal and financial issues, but it is important to contact an experienced attorney to understand their rights.

A successful civil claim would enable surviving victims and families who lost loved ones to cover medical expenses, funeral expenses, lost wages, and pain and suffering as a result of the crash. Unfortunately, these claims typically take years to settle. Financial strain not only seriously impacts a victim’s life, it also impacts the case. Once a lawsuit is under way, if a plaintiff needs financial assistance, litigation funding may be a valuable option.

Litigation funding is a non-recourse cash advance against the future proceeds of the case. It is a smart strategic move because it allows a litigant to pay immediate bills while waiting for proper case resolution, rather than being forced into a low settlement offer.

To qualify, a plaintiff needs attorney representation and a strong case with merit – that’s all! There is no need for a credit check, employment verification or collateral. Funding decisions are typically made within 24 – 48 hours of receiving an application and applicable case documentation. The only payment made is when the case successfully settles. If the case is lost, the repayment is completely waived.

Why worry about money when a lawsuit cash advance would ease the burden immediately?

May 9, 2017

A personal injury is that life-changing moment when you are seriously injured as the result of someone else’s negligence or carelessness. The most obvious example of this is an automobile accident.

Waiting for a personal injury case to settle can be very difficult financially and mentally. Injuries may prevent the victim from earning a living and support a family. A financially desperate plaintiff is not in a favorable position regarding settlement negotiations; this person will often settle for too little, too soon. Litigation funding helps plaintiffs take care of financial obligations while giving their attorney the time needed to seek appropriate justice.

A Missouri man recently filed an auto accident lawsuit against a commercial trucking company alleging negligence.
According to the complaint, the plaintiff alleges that in September 2015, he was traveling in a Dodge Ram pick-up truck when he collided with a semi-truck. The pick-up was heavily damaged and had to be towed from the scene.

The plaintiff alleges that the cause of the crash was because the semi driver failed to reduce speed, failed to yield the right-of-way, and failed to keep a proper lookout. The suit also claims that the trucking company failed provide adequate training and failed to obey the Federal Motor Carrier Safety Regulations, Illinois law, safe trucking industry standards and safe commercial truck driving rules.

As a result of the crash, the plaintiff claims he suffered physical injuries and incurred expenses in excess of $60,485.02. He requests a trial by jury and seeks judgment for a sum in excess of $100,000.

During the litigation process, the plaintiff’s attorney must prove the driver of the tractor trailer was negligent at the time of the accident. This could take months, even years. Without sufficient savings, the plaintiff may have a hard time paying medical expenses, the mortgage/rent, or even put food on the table. For someone with pressing financial needs, waiting is not an option. As long as the case is strong and the plaintiff has attorney representation, litigation funding is usually a viable solution.

Lawsuits Pending Against Trucker and Trucking Companies In Chain-Reaction Crash That Killed Four

November 17, 2016

An Indiana truck driver charged in a 2014 crash that killed five people pleaded guilty to five counts of reckless homicide and one count of falsifying his driving log. He faces six to 28 years in prison, but prosecutors have agreed to seek no more than a 15-year sentence.

On July 21, 2014, the truck driver entered a construction zone where traffic had slowed to 3 – 5 miles per hour. The trucker, however, had set his cruise control and was driving 65 mph when he entered the area, causing a chain-reaction crash that killed four people, including an 11-year-old girl. Four others (a woman and her three teens) were hospitalized with injuries.

Two lawsuits filed by families of the victims are pending in federal court. The lawsuits name the truck driver as well as Steel Warehouse, the company for which the trucker was hauling freight, and Eagle Transport, the company which leased him the semitrailer he was driving. The suits allege that the trucker was speeding through a construction zone, failed to keep a proper lookout for slowing or stopped vehicles, failed to slow down when a special hazard existed and had a physical condition — complete loss of vision in his right eye due to a 1984 injury — that limited his ability to drive safely. The plaintiffs also allege that he altered his driving log to make it appear as if he started work later in the day than he actually did. According to investigators, the truck driver began his workday at 2:30 a.m. when he picked up a load of steel at a warehouse in South Bend, Ind. His log book, however, showed he started at 6:15 a.m. Under federal law, commercial truck drivers are limited to working 14 hours a day, including a maximum of 11 behind the wheel. A hearing date is set for December 6.
