A Georgia nursing home settled a wrongful death lawsuit on the eve before the case was set to go to trial.
According to the lawsuit, the deceased man had been sent to the facility for rehabilitation services after a stroke. During his stay, the man develop pressure sores and was found to be dehydrated and malnourished. His widow alleged that poor care caused her husband’s declining health, and ultimately his death from gangrene-infected pressure sores.
The case settled for an undisclosed amount.

The nursing home had consistently received below average ratings as a result of numerous violations and had been named in several lawsuits over the last ten years. The facility declared bankruptcy and was sold this past May.
If you or a loved one suffered physical or emotional injuries because a nursing home was negligent or failed to fulfill its care obligations to you and your family, you may have grounds for a nursing home negligence case.

Contact an experienced attorney as soon as possible. If you are seeking lawsuit funding to help during a financially difficult time, consider lawsuit funding to hold out for full case value.

Lawsuit funding is used by most people to pay their medical bills, funeral expenses, and ordinary but important bills and expenses that accumulate because of serious injury or death. The strategic advantage of a lawsuit cash advance is that it provides the plaintiff with the financial strength to await for a reasonable offer from the insurance company or defendant.

The application process is easy and may be handled over the phone or online; it takes less than five minutes. There are no upfront fees, monthly payments, credit checks, or employment verification. Once an application and case documentation is reviewed, if the case is approved for funding the plaintiff can receive the money within 24 – 48 hours. Repayment is contingent upon case outcome; if the case is lost, there is no requirement to pay the money back. Thus, lawsuit funding is a no-risk lawsuit cash advance.

If you or a loved one has filed a nursing home negligence lawsuit, but need financial assistance, Litigation Funding Corporation can devise a legal finance plan to help. Lawsuit funding can often be the difference between a mediocre settlement and a large, injury appropriate settlement. We offer free, no-obligation consultations. Nebraska Man Charged with Manslaughter Following Fatal Drunk Driving Crash

March 3, 2017

A single-vehicle crash in central Nebraska claimed the life of two young men, after a heavy-duty pick-up truck left the roadway, ran into a ditch, and rolled at least one full rotation before coming to a rest. Two passengers were ejected; they were pronounced dead at the scene. The driver and three other passengers were taken treated for injuries at a nearby hospital. Multiple beer cans allegedly were recovered from the accident scene.

Police reports state the driver had a blood alcohol level of .09; the legal limit to drive in Nebraska is .08. He was charged with two counts of felony manslaughter and driving under the influence of alcohol. He could face up to 40 years in prison. He could also face wrongful death lawsuits.

An experienced auto accident attorney can help protect the rights of the victims and help them receive compensation for their loss. Even with the help of an experienced attorney, a lawsuit can drag on as the insurance company for the negligent driver will most likely deny fault and delay the litigation process. For the victim’s family, life won’t wait for a lawsuit to settle nor should they be forced to settle for pennies on the dollar because of pressing financial needs. When finances are an issue, litigation funding can be a solution.

Litigation funding is a cash advance of an expected settlement. Its main purpose is to assist plaintiffs with the likely loss of wages, mounting medical bills, funeral expenses, daily household bills, and other out-of-pocket expenses until a settlement is reached. Unlike a traditional bank loan; funding can be obtained without the need for a credit check or employment verification; the only collateral required is a pending lawsuit. Funding is based strictly on case strength.

Request for funding applications can be made over the phone or online, with approvals as quickly as 24 hours. Once a contract is signed, the money is sent via overnight mail or direct deposit. Funding is provided on a non-recourse basis. When the case settles, the cash advance is repaid from the case proceeds. If the plaintiff fails in achieving a settlement, repayment is completely waived.

If you have been seriously injured or lost a loved one due to a drunk driver and need financial assistance, consider litigation funding to help wage your legal battle for the best possible settlement. Contact the experienced and professional staff at Litigation Funding Corporation. We would be happy to answer all your questions and help you understand the lawsuit finance process.

Princess Cruise Passenger Sues for Sewage Slip and Fall

January 11, 2017

While most slip and fall accidents are simply ‘just accidents’, there are some accidents that happen due to the negligence of the cruise line or its employees. Establishing negligence by the cruise line and then proving that negligence can be quite difficult. Injured passengers should seek legal advice from an attorney experienced in maritime laws (the laws of the seas).

A passenger aboard one of Princess Cruises’ ships has filed a lawsuit resulting from a slip-and-fall accident aboard while vacationing with her husband last year.

According to the complaint, the cruise ship was docked for repairs to its sewage system. The plaintiff claims she went to a public restroom aboard the ship, but the toilet was overflowing with sewage and she slipped and fell, striking her face on the door. She says that she was knocked unconscious, laying on the contaminated bathroom floor. The lawsuit states that as a result, the woman had to get a tetanus shot and was placed on various antibiotics. The lawsuit claims the cruise company is responsible for her permanent injuries and emotional distress.

Maritime laws apply not only to injured workers, but, also to passengers. The cruise ship is obligated to keep areas free from hazards and alert passengers as well as employees about dangerous conditions. A cruise ship company will generally be liable to its guests and passengers for injuries sustained that are a result of negligence when the operator knew or should have known about the dangerous condition. The most common injuries include slip and fall accidents.

Whether you are injured as a passenger or an employee at sea, it is highly recommended that you retain the services of an experienced maritime attorney to pursue your case. Litigation Funding Corporation has strategic relationships with attorneys all over the country who specialize in this area of the law. Our attorney referral program promises to locate a legal specialist in any area of the law, including Maritime law, with 48 hours of your request.

Often times, those involved in a cruise ship accident lawsuit eventually face financial hardships. Many can’t work and the legal process is long and drawn out. Some cases take many years to resolve. At times like this, Litigation Funding Corporation can help. We can provide litigation funding to pay your extraordinary medical expenses, mortgage or rent payments, car payments, food, utilities or other important expenses.

Once we received a funding application, we will request some case documentation, evaluate the lawsuit to determine funding, and if approved, direct deposit or overnight mail funding within 24 – 48 hours. There is no need for a credit check or employment verification; we are simply repaid once the case settles. If there is no recovery on the case, no money is repaid. It’s that simple!

If you have been injured on a cruise ship due to negligence of the crew or cruise line, you may have a potential claim. Once you file a lawsuit, if you are financially strapped, leverage our money into a larger case settlement. Contact us at 1.866.LIT.FUND to learn more or apply online to get started.

Construction Zone Accident Draws Two Lawsuits; Deceased Family Can Seek Litigation Funding

October 6, 2016

Highway construction workers put their lives at risk on a daily basis for the safety of others. Despite all the equipment and other hazardous conditions in an active work zone, traffic remains the most dangerous. Many drivers tend to ignore warning signs; even when they do pay attention speeding and driver inattention/distractions are the major causes of road construction accidents.

A motorists who struck and killed an Alabama Department of Transportation (ALDOT) employee is facing two separate lawsuits – one from the victim’s estate and another from the state highway department.
The ALDOT worker was removing traffic control barriers in a work zone at the time of the crash. It was a rainy morning, and the right lane was closed. According to the crash report, the driver was following too closely when he struck another vehicle. He then veered off the right side of the interstate, striking a trailer attached to the back of an ALDOT truck. Another ALDOT worker was injured when he was struck by the trailer. Then, the negligent driver struck the deceased and the ALDOT truck. The negligent driver claimed the chain of events was caused because another motorist cut him off.

ALDOT is seeking compensatory damages of $21,868, plus costs and expenses. Defendants are the negligent driver and the owners of the vehicle he was driving. The estate of the deceased filed the case last month against the negligent driver and the deceased man’s own insurance company. The lawsuit is asking for a jury trial.

Pros To Litigation Funding

December 8, 2015

Litigation funding is a way for plaintiffs to get access to cash needed before receiving a settlement. Because a wealthy defense litigant – big business and insurance companies – can outspend the average citizen, litigation funding may be the only hope to pay the bills while maintaining a fight for fair compensation. Lawsuit Financial does not “lend” money; it invests in lawsuits. While a plaintiff is required to potentially pay back a higher return than average on the advance, remember we take the risk of complete or partial loss. In our opinion, the pros for litigation funding far outweigh the cons.

Pros
• Immediate financial assistance when you need it most. Pay immediate bills and expenses – mortgage, rent, auto payments, medical bills, daily household expenses; stop creditor calls.
• Quick turnaround time – typically within 24 – 48 hours
• The only requirements when seeking lawsuit funding is to have an ongoing case and retain an attorney.
• No need for a credit check. Unlike a bank loan, bad credit doesn’t matter.
• No need for employment verification
• No need to be pressured into an early, smaller settlement. Litigation funding allows you to fight for compensation you deserve.
• No risk to you. Funding is on a non-recourse basis meaning that the repayment obligation is contingent on you winning the case. Lose and the repayment is waived.
• Repayment comes from the settlement, not upfront and not through monthly payments.

Cons
• Litigation funding can be expensive. This is because the funding company assumes all the risk and must off-set any lose with higher rates.

If you are strapped for cash, do not settle for less than case value. Litigation Funding Corporation may be able to provide you the needed cash to wait for the legal system to do its job. To apply for litigation funding, complete and submit our online application. Plaintiffs Can Breathe Easy With Litigation Funding During a Pending Lawsuit

April 9, 2015

There is not much worse than realizing that an incident during birth caused your child’s serious injury. A birth injury typically occurs because of a complication during the labor or delivery process. Due to the fact that birth injuries often cause oxygen deprivation, many medical malpractice birth injuries lead to serious and even permanent birth defects. During the emotional litigation process, plaintiffs should be able to meet their financial needs, especially in providing care for the child. Litigation Funding Corporation can provide litigation funding without obstacles or risks.

A $17.5 million settlement was recently reached in a birth injury lawsuit involving a boy who was left permanently disable. The plaintiff alleged that the T.J. Samson Community Hospital in Glasgow, Kentucky and the obstetrician were negligent during her labor and delivery of her son, resulting in her son being born with spastic quadriplegia (a form of cerebral palsy). Jurors found the hospital negligent and liable, however, the doctor was cleared of any liability. Despite the evidence and jury award of $18.27 million suggesting medical malpractice, the hospital and its nursing staff admit to no wrongdoing. The plaintiff agreed to settle for $17.5 million. In return, the hospital agreed not to appeal the verdict.

In 2007, the expected mother arrived at the hospital to delivery her son. The doctor ordered Pitocin, a labor induced drug, known to cause complications for many women and newborns. According to the lawsuit, the obstetrician left “standing orders for the administration of the Pitocin,” and informed attending medical staff that the contractions should not exceed more than four contractions within an hour. Additionally, the doctor encouraged a lower epidural dose as a preventative measure, as the mother was having trouble pushing during the final stages of labor. Despite doctor’s orders, evidence revealed that the hospital staff did not follow the doctor’s orders and had the woman exceed the maximum amount contractions per hour for an entire six hours, resulting in oxygen deprivation to the baby’s brain. Additionally, nurses failed to reduce the epidural dose, which allegedly caused the baby to become stuck in the birth canal, also resulting in oxygen deprivation. The child now suffers from spastic quadriplegia, a severe form of cerebral palsy.

Children with spastic quadriplegia usually suffer widespread brain damage or significant brain malformations. Most children with spastic quadriplegia are never able to walk and have trouble speaking and being understood. Additionally, children with this form of cerebral palsy tend to display a floppy neck and severe stiffness in the limbs. They often suffer from frequent seizures that are particularly difficult to manage. The little boy will require life-long care for his disability; his estimated life expectancy is 67 years. These factors may have ultimately contributed to the jury award.

Although the case took nearly eight years to settle, the couple is happy to know their daughter will be provided for their rest of her life.

I don’t know this family’s financial situation, but I would guess that the medical expenses alone left them financially strapped. During this long ordeal, they may have qualified for litigation funding, a non-recourse cash advance against their pending lawsuit. Even if they did not settle and an appeal was filed, litigation funding could have still been an option to alleviate some financial burdens.

The level and expense of care needed for a special needs child are high. While litigation funding cannot solve physical and emotional issues, a lawsuit cash advance can substantially lessen the financial issues. Funding is based solely on the strength of the case; if the case is reviewed and appears to be winnable, the application will likely be approved with funds available within 24 – 48 hours. No money is owed until the case successfully settles at which time repayment is made from the proceeds of the case. If the plaintiff loses the case, repayment is waived completely. The application process is quick and easy by phone or online because we don’t care about credit-worthiness or job history. Most documentation we need to determine case merit is requested from, and provided by, the plaintiffs’ attorney.

If you have filed, or plan to file, a medical malpractice lawsuit and are represented by an attorney, you may be eligible for medical malpractice litigation funding. Litigation Funding Corporation is one of the few litigation financing companies with the expertise to evaluate and provide legal finance for these complicated cases. For a free, no-obligation consultation or funding analysis, contact us online or by phone.

20 Foot Fall From Lift Is Fatal to Construction Worker

March 26, 2010

Construction accidents usually result in serious injuries; this one was fatal for one worker and caused serious injuries for another. The construction accident took place in Louisiana at a job site in the East Baton Rouge school system.

It appears that the two construction workers fell a distance 20 feet to the ground after the lift they were balanced on was struck by a beam. One worker suffered a catastrophic traumatic brain injury and was pronounced dead at the scene. The second man was taken to hospital for treatment of his serious injuries.
Both men worked for a steel fabricator at the time of the accident. The police report isn’t clear as to what precisely took place, but from eyewitness reports, it appears that the crane operator moving the beam from one place to another didn’t pay attention to what he was doing and hit the lift.

The surviving construction worker and the family of the deceased construction worker may want to consider filling both a workers compensation case and, if the crane operator was not a co-employee of the same employer as the victims, a personal injury lawsuit against the crane operator and his employer for negligence in operating the unit. Cases like this take some time before they are resolved; in the meantime, the worker and his family and family of the deceased worker may need money now, to pay their bills and expenses and, in the future, as they wait for the case to wind down the long litigation road.
A lawsuit cash advance may work well for both victims here. The victims could apply for litigation funding; if they are approved, they would receive instant cash just when they need it most. This vital lawsuit financial assistance may be used to pay all the necessary medical expenses, funeral expenses and the ordinary expenses that personal injury and wrongful death victims fall behind on when accidents or tragedy happen. Lawsuit funding tries to bridge the gap between lawsuit and case settlement or resolution; legal finance companies do not need credit checks. Lawsuit finance companies look for solid personal injury cases with a reasonable chance of success.
