Young Michigan Girl Killed in Crash, Her Two Siblings Injured

October 19, 2016

Police are investigating a Locke Township, MI crash that killed an 11-year-old girl and seriously injured her two older siblings.

Just before 8 a.m., a 16-year-old girl was driving southbound when a northbound driver turned in front of her. After the vehicles collided, the teen’s car hit a tree. The 11-year-old died at the scene. The 16-year-old driver was taken by Life Flight to a nearby hospital and her 14-year-old brother was taken by ambulance. Both were listed in serious, but stable condition. The driver of the northbound vehicle was uninjured.

An investigation will help determine if one or both drivers were responsible. Many factors will be examined such as whether the driver traveling northbound failed to yield or if the teen driver was speeding. In the meantime, the family of the deceased and injured teens may wish to consult an experienced attorney to understand their rights. They may be able to seek compensation for funeral expenses, medical expenses, pain and suffering, and other damages as a result of the accident.

Litigation Funding: A No-Risk Financial Lifeline For Personal Injury Plaintiffs

September 6, 2016

A “personal injury” case is a legal dispute wherein one person is injured or harmed and another individual or company may be legally at fault for the harm that person incurred. These types of cases often take a significant amount of time to move through proceedings, which can leave the injured person in a precarious financial situation. If the injured person is unable to work, has reduced income, or has expenses associated with care or disability, it may not be possible to wait until a settlement is reached before obtaining funds. What is a victim to do? How does one make ends meet, financially, while battling a well-financed insurance company with all the time and money in the world? One option is to call Litigation Funding Corporation.

We provide lawsuit cash advances, known as litigation funding, to plaintiffs who are in a pending claim, including but not limited to auto accidents, slip and fall accidents, medical malpractice suits and product liability cases. The benefit of litigation funding is that the plaintiff gains access to funds in advance of a settlement. The money can be used any way the client wishes, but is typically to cover the mortgage or rent, car payments, medical expenses and ordinary living expenses.

This source of funding is provided with no-risk because unlike a traditional bank loan, we require no credit check, employment history, or monthly payments. We are only repaid once the case settles. However, if a funded client does not obtain a recovery on his/her personal injury case, we do not recover the advance.

If you have found yourself in a pending lawsuit and struggling financially to make ends meet, complete an online funding application or call our office. We will contact your attorney to obtain information about the case. Based on the information received, our underwriters will make a funding decision within 24 – 48 hours. If your case is approved for funding and you accept the offer, you and your attorney will sign a funding agreement. Then, we will wire the funds directly into your bank account or send a check via overnight mail. Wrongful Death Lawsuit Filed Against Teen Driver Who Allegedly Violated State Graduated Licensing Law

August 15, 2016

A New Jersey teenager and her father have been named in a wrongful death lawsuit stemming from fatal motorcycle crash in June.

The 17-year-old girl struck the rear of the motorcycle as she attempted to cross Route 15 at the same time the 47-year-old motorcyclist was passing. The motorcyclist died of multiple blunt force injuries within minutes of the crash, according to the death certificate.

The teen has not been charged with any criminal offense, but was cited for making an unsafe lane change and having three other teens in the vehicle at the time of the crash, a violation of New Jersey’s graduated driver’s license program. She also did not have a red decal on the license plate of her vehicle indicating she was a teen driver, as required by Kyleigh’s Law. New Jersey is the only one to have a teen driver decal law. The law also sets an 11 p.m. curfew for drivers with a learner’s permit, restricts the number of passengers to one, unless accompanied by a parent or guardian, and bars teen drivers from using handheld electronic devices.

The lawsuit alleges that as a result of the teen’s negligence and recklessness, the motorcyclist was severely injured, suffered great pain and mental anguish and ultimately died soon after impact as a result of his injuries. His widow, son and stepson are seeking undisclosed compensation and asserting loss of consortium. The lawsuit contends that her father, the owner of the vehicle, “negligently entrusted operation of the vehicle” to his daughter and he allegedly knew she was driving in violation of the state’s graduated license law.

Losing a loved one unexpectedly can be extremely difficult and painful. Even when liability appears straightforward, the case can drag on for months, even years. The wait will often put victims in a financial predicament. Do they accept the insurance company’s inadequate settlement offer to avoid pay the bills and possibly avoid home foreclosure?

While Litigation Funding Corporation cannot bring back a loved one, we can help put an end to the financial struggles most plaintiffs face while waiting for a settlement to be reached. Litigation funding is a non-recourse cash advance to help take care of life’s necessities (mortgage, rent, food, utilities, gas, car payments, medical expenses, transportation, etc.). Eligibility is based on attorney representation and a strong case. Once these qualifications are met, the application process is quick and easy; it takes less than five minutes online or over the phone. Next, we will obtain basic information about the case from the plaintiff’s attorney. After our underwriters review the information, if the case is approved, funds can be available within 24 – 48 hours. There are no credit checks, employment verifications, or monthly payments. Repayment is made from the proceeds of the case, and there is obligation to repay the cash advance if the case is lost. That is correct – we only get paid back the cash advance if our client successfully settles.

Lawsuits Begin after 86 Children Sickened by Staph Found in Daycare Food Samples

June 29, 2015

Following an illness outbreak likely caused by Staph at a Montgomery, Alabama daycare, multiple lawsuits have been filed on behalf of the parents of children affected. The lawsuits allege that the children became ill after consuming contaminated food because the child care facility did not use proper procedures while preparing, serving and storing the food.

The Alabama State Department of Health said four out of eight food samples from the items served during the lunch hour at two Sunny Side Daycare Center were positive for the Staphylococcus aureus toxin. The results of nine additional samples are still pending. Both daycare locations will remain closed until the investigation is complete. Overall, 86 children under the age of 10 sought treatment at area hospitals and 30 of those were hospitalized.

A daycare facility should be held accountable for hurting these children; it is only right for their parents to be properly compensated. The litigation process can be physically and emotionally draining for both the children and the parents. It may also be financially difficult especially with medical expenses. Litigation funding can help these victims fight for justice. With a lawsuit cash advance, they won’t have to be swayed by a tempting low settlement offer nor will they have to go through hassles that usually are involved with a traditional bank loan. Qualification for funding is based solely on the merits of the lawsuit. A reputable company charges no upfront fees and no monthly payments; there are no credit checks or employment verifications. Best of all, if the plaintiff loses his/her case the litigation funding company relinquishes the cash advance; the plaintiff owes nothing.

A lawsuit cash advance is easy to apply for either by phone or online. After case-evaluation, if approved, funds can be available within 24 – 48 hours. Call Litigation Funding Corporation or visit us online to find out how lawsuit funding can empower you to pursue your case to get the maximum settlement you deserve.

Lawsuits Filed Against Six Flags Magic Mountain

July 28, 2014

Roller coasters are generally safe, but they are also the most dangerous rides at amusement parks. The “scare factor” is the thrill of the twists, turns, and speed. Unfortunately, sometimes terrifying accidents occur. When someone is injured due to negligence on the part of someone else, victims may seek compensation for damages. They may also seek pre-settlement funding to help pay expenses until their case settles.

The latest scare occurred on the Ninja at Six Flags in California. The roller coaster derailed when a tree branch fell on the tracks, stranding 22 riders for hours. The front part of the roller coaster detached from the track and dangled at about a 45-degree angle, pointing to the ground; the car was about 20 feet in the air. Four people were injured as a result.

While the California Department of Industrial Relations is investigating whether the park is responsible for the crash, two victims have filed lawsuits against Six Flags Magic Mountain, seeking unspecified damages. The suits allege that the park’s negligence caused the ride to be “dangerous, defective, hazardous and unsafe.” The plaintiffs seek compensation to cover medical expenses and lost wages. Unfortunately, the wheels of justice could take a long time. If they are living paycheck to paycheck, time may not be on their side. To avoid financial ruin or settling too soon for too little, the plaintiffs may want to seek pre-settlement funding.

A pre-settlement cash advance provides much needed cash to cover bills and expenses during the litigation process so the plaintiff’s attorney can pursue the case to full settlement value. Pre-settlement funding is a risk-free advance; there are no payments until the case settles and if the case is lost, the repayment is waived. To apply, simply complete an online application. Once the underwriters evaluate the case, if approved, funds can be available in as little as 24 hours.

If you have questions or would like to learn more if pre-settlement funding fits your case, contact us online or via phone at 1-866-548-3863.

Caltrans May Face More Wrongful Death Lawsuits

June 26, 2014

While the cause of a fatal accident in San Bernardino is underway, family and friends mourn the death of two teens and Caltrans may be facing another lawsuit.

A dump truck hauling 80,000 pounds of wet cement lost control and collided with a PT Cruiser in the Cajon Pass sending the vehicle down a dirt embankment. The dump truck rolled several times before landing on top of the Cruiser. Two of the five passengers inside the Cruiser died at the scene; the other three were injured. The dump truck driver, who was working as a subcontractor for California Department of Transportation (CalTrans), was not injured.

An initial investigation indicates that the truck driver lost control for an unknown reason and failed to stop at an intersection. The California Highway Patrol is investigating whether there was a mechanical issue; unconfirmed reports that the dump truck’s brakes failed. Alcohol and drugs did not appear to be a factor in the accident. This is the fourth fatal accident to claim two or more victims in the region since Mother’s Day.

The families of the deceased may choose to file a wrongful death lawsuit against the truck driver and Caltrans. Caltrans may be held liable for failing to maintain the dump trick and/or failing to maintain and improve dangerous road. But, winning a wrongful death lawsuit resulting from a dangerous road accident involves proving the government was aware of a significant danger, but failing to fix it. Whether a lawsuit is filed against Caltrans or not, the negligent driver may still be held accountable.

Suffering the loss of a loved one is enough of a hardship; the last thing the families need is to face significant financial hardship, too. We understands how hard it is to stay financial afloat during a lengthy litigation process. If you are in need of a financial lifeline until your case is settled, consider litigation funding.

Litigation funding is financial assistance during the litigation process to help innocent victims pay mounting medical bills or funeral and burial expenses. With this non-recourse cash advance, plaintiffs can take care of their financial obligations while giving their attorney the time needed to seek appropriate justice.

We work directly with your attorney to gather necessary information to process your funding request as quickly as possible. Funding is based on the merits of the case, not on credit-worthiness or employment history verification. Litigation funding is a non-recourse cash advance, meaning that it is paid back only out of the settlement of the case. If you don’t win the case, the cash advance does not have to be repaid.

To determine if you qualify for litigation funding, complete our online application or call us toll-free at 1-866-548-3863. If approved, cash can often be available in as little as 24 hours.
